General And Purchase Conditions

The owner of the online store sunnydayfabrics.com (hereinafter the Online Store) is Sunnyday OÜ (registration code 14126779, located at Rähni tee 1 Kloogaranna Harjumaa).

Validity of Sales Contract, Product and Price Information

The sales terms apply when purchasing goods from the Online Store.
The prices of products sold in the Online Store are indicated next to the products. A fee is added for the delivery of goods.
The delivery fee depends on the buyer’s location and the delivery method. The delivery fee is shown to the buyer when placing an order. All displayed products may not always be in stock. Displayed product images may differ from the actual product. Product descriptions in the e-store may not be exhaustive and may contain unintentional errors. Information about the product is provided in the Online Store directly next to the product.

Placing an Order

To order goods, add the desired products to the shopping cart. To finalize the order, fill in the required data fields and choose a suitable delivery method. The amount then displayed on the screen can be paid via a bank link.

The contract comes into force once the amount to be paid is credited to the Online Store’s account. If the ordered goods cannot be delivered due to the end of goods or any other reason, the buyer will be notified at the earliest opportunity and the paid money (including delivery costs) will be refunded immediately, but no later than 5 days after sending the notification.

Coupons – During various campaigns, we offer customers discount coupons. We distribute coupons on social media (Facebook) and on the website. The conditions and deadlines for using coupons are specified individually with each discount coupon.

Description of Payment Methods and Currency

For bank payment links, we work with Montonio. After placing the order, click on the desired bank link, which will redirect you immediately to the chosen internet bank: Swedbank, SEB, Luminor, LHV Bank, Coop Bank, Citadele Estonia. Enter your username and passwords and log in to the internet bank. In the internet bank, you will see a filled payment order with the amount payable for the purchased products. Confirm or cancel the payment order and click “Back to Merchant”.

You can also pay with Visa or Master card. The transaction currency is Euro.

Delivery

Goods are sent within Estonia. All products are delivered via Itella SmartPost, DPD, and Omniva to the package terminal selected by the customer. The delivery costs are borne by the buyer, and the relevant price information is displayed next to the delivery method. Goods are generally delivered via Itella SmartPost, DPD, and Omniva to the destination selected by the buyer within 3-7 working days from the entry into force of the sales contract.

The maximum delivery time is 7 working days from the entry into force of the sales contract.

The customer has the option to pick up the products themselves. After a successful payment, the Online Store representative will send an email and arrange the delivery of the product.

Withdrawal Right

After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-store within 14 days.

The right of withdrawal does not apply if the buyer is a legal entity. To use the 14-day right of return, the ordered goods should not be used in any way other than is necessary to determine the nature, characteristics, and functioning of the goods in the way it is allowed to test goods in a physical store. If the goods have been used for purposes other than necessary to ascertain the nature, characteristics, and functioning of the goods, or there are signs of wear or use, the Online Store has the right to reduce the refund according to the decrease in the value of the goods.

To return the goods, a declaration of withdrawal from the purchase of the goods must be submitted, the form of which can be found here: withdrawal declaration and sent to the e-mail address info@sunnydayfabrics.com no later than 14 days from receipt of the goods.

The buyer bears the cost of returning the goods, except when the reason for the return is that the returned item does not correspond to the ordered item (e.g., incorrect or defective item). The buyer must return the goods within 14 days of submitting the withdrawal declaration or provide proof that they have handed over the goods to the carrier within this period.

Upon receipt of the returned goods, the Online Store will immediately, but not later than 14 days after receiving the withdrawal declaration, refund to the buyer all fees received from the buyer under the contract.

The Online Store may refuse to issue refunds until the item which is the object of the contract has been received back or until the buyer has provided evidence that they have returned the item, depending on which occurs first. If the buyer has expressly chosen a delivery method different from the cheapest regular delivery method offered by the Online Store, the Online Store does not have to reimburse the cost exceeding the cost of the regular delivery method for the consumer. The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the Online Store was marked significantly below the market price due to an error.

Right to Submit a Complaint

The Online Store is responsible for any non-compliance with the terms of the contract or defects in the goods sold to the buyer that were present at the moment of delivery and that occur within two years from the moment of delivery to the buyer. It is assumed that such defects were present already at the time of delivery during the first year of delivery to the buyer. It is the Online Store’s obligation to refute this presumption. The buyer has the right to turn to the Online Store due to a defect within two months of its appearance by sending an email to info@sunnydayfabrics.com or calling 53311165.

The Online Store is not responsible for defects that appear after the delivery of the goods to the buyer. If goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Online Store will refund the buyer for all fees incurred under the sales contract. The Online Store responds to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.

Direct Marketing and Processing of Personal Data

The Online Store uses the personal data entered by the buyer (including name, telephone number, address, email address, bank details) only for processing the order and sending the goods to the buyer. The Online Store forwards personal data to the transport companies providing delivery services to deliver the goods. The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed a wish to receive such notifications by entering their email address on the website and indicating a desire to receive direct mail offers. The buyer can unsubscribe from offers and newsletters sent to their email at any time by notifying us via email or by following the instructions provided in the email containing the offers.

Dispute Resolution

If the buyer has complaints regarding the Online Store, they should contact via the email address info@sunnydayfabrics.com or call 53311165. If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer has the possibility to turn to the Consumer Disputes Committee. The terms and conditions of proceedings can be found on the website, and an application can be submitted via email. The Consumer Disputes Committee has the authority to resolve disputes arising from the contract concluded between the buyer and the Online Store. Reviewing a buyer’s complaint by the committee is free of charge. The buyer may also turn to the platform for resolving consumer disputes of the European Union.
